Social Security Fund — Missing Contribution Records

The Situation

A retired Thai national discovered that five years of Social Security Fund contributions appeared to be missing from her official records. The Social Security Office had no record of those years, though she had continued working during that period. Her employer from that time had since ceased trading.

What We Did

We assisted the client in locating employment and payroll records from that period, obtained confirmation from former colleagues, and submitted a formal rectification request to the Social Security Office with the assembled evidence. Correspondence was managed throughout. Duration: approximately four months.

The Outcome

The Social Security Office updated her contribution records after review. Her monthly pension entitlement increased by approximately 18% as a result. The client had previously been told by the SSO that nothing could be done without documentation that she did not hold herself.

Provident Fund — Disputed Entitlement at Resignation

The Situation

An expatriate employee who had worked for a Thai company for eleven years resigned and was informed by the provident fund manager that his vesting entitlement was significantly lower than he had expected, based on the fund's interpretation of the vesting schedule in his employment agreement.

What We Did

We reviewed the fund agreement and employment contract in detail, identified an ambiguity in the vesting schedule language that had been interpreted to the fund's advantage, and submitted a formal objection with a written legal analysis. Negotiations with the fund manager followed over a period of six weeks.

The Outcome

The fund revised its calculation and paid out the higher amount — the full eleven-year entitlement at the rate the client had understood. The additional amount recovered was materially larger than the engagement fee. The client did not need to proceed to formal dispute proceedings.

Employer Pension Scheme — Delay and Non-Payment

The Situation

A Thai national approaching 60 had reached retirement under her employer's occupational pension scheme but payments had not commenced six months after they were due to begin. Initial correspondence with the employer had gone unanswered. The employer was an active, solvent company.

What We Did

Following a Clarity Consultation, the client engaged us for full representation. We issued a formal demand letter with a legal analysis of the employer's obligations under the pension scheme rules and Thai labour law. When no response was received, we escalated through the relevant Department of Labour Protection channels.

The Outcome

Payments commenced within ten weeks of the formal demand, including back-payment of the six months that had been delayed. The matter did not proceed to formal litigation. Total duration from our engagement to resolution: approximately eleven weeks.
